projects of interest to agribusiness are waiting for the end of the parliamentary recess, on Monday, August 1st, to return to the committees.

One of the projects that are being processed by the Agriculture and Agrarian Reform Commission (CRA) is PL 1,459/2022, which revokes the current Pesticides Law and changes the rules for the approval and marketing of these chemicals.

Other projects that must be deliberated by the CRA and the Environment Commission (CMA) are PL 2,159/2021, which deals with the General Environmental Licensing Law, and PL 2,633/2020 and PL 510/2021, related to land regularization.

Bill of Pesticides

PL 1,459/2022 replaces Senate Bill 526/1999, by Senator Blairo Maggi. The proposal was approved in both houses and returned to the Senate in the form of a substitute.

Because of these manifestations, the last CRA meeting before the recess, senators chose to approve the request to resume the proposal to hear representatives of the Ministry of Agriculture, Livestock and Supply (Mapa), the Brazilian Institute of the Environment and Renewable Natural Resources (Ibama) and the National Health Surveillance Agency (Anvisa).

An application was also approved by the Senator Paulo Rocha (PT-PA) to hear the United Nations (UN) special rapporteur, Marcos A. Orellana, on the human rights implications of environmentally sound management and disposal of hazardous substances and waste.

On the other hand, the PL on Bioinputs, authored by Deputy Zé Vitor (PL-MG), is also in progress, which provides for the classification, treatment and production of bioinputs through on-farm biological management and ratifies the National Bioinputs Program. The project was designed to oppose the PL on Agrochemicals and is awaiting approval from the CMA.

environmental licensing

The proposal for a General Law on Environmental Licensing. In joint analysis by CMA and CRA, PL 2.159/2021 demanded three public hearings and is awaiting the report by Senator Kátia Abreu (PP-TO).

The matter was processed in the Chamber for almost 20 years and reached the Senate in 2021. The project involves types and exemptions of licensing, self-declaration, deadlines, responsibilities, among other particularities that extend to all entities of the Federation.

Land regularization

PL 510/2021 amends Law 11,952/2009, which provides for the land tenure regularization of occupations in lands located in areas of the Union.

The original text of the project changes the time frame for proof of occupation, from July 22, 2008 to December 10, 2019. In addition, the size of the modules to be regularized across the country increases to 2,500 hectares.

Land tenure regularization underwent three joint public hearings and is now being processed by the Agriculture Commission.
